Divorce Petitions

Filed in Family Court to legally end a marriage and address related issues such as property and debt division, spousal support, child custody, parenting time, and child support, if applicable.

Child Custody and/or Child Support Petition

A case filed in Family Court to determine custody, parenting time, and/or child support when the parents do not already have a court order addressing these issues.

The custody packet may be accessed by clicking the "Custody Packet" icon. These forms are intended for use by parents only and are not appropriate for grandparents or other third parties. Please review the Family Court notice regarding the use of these forms before filing.

If you are seeking to change an existing custody or support order, or if you believe an existing court order is not being followed, please select the Modification and Contempt tab above.

Petition for Modification and/or Contempt

Petition for Modification – A petition for modification asks the Family Court to change an existing court order because circumstances have changed since the order was entered.

Modification Packet

Petition for Contempt – A contempt petition asks the Family Court to enforce an existing court order when a party believes the other party has not followed the order.

Contempt Packet

Expedited Modification – An expedited modification requests a change to an existing child support or spousal support order due to a significant change in circumstances.

Domestic Violence Protective Order (DVPO)

A petition for a domestic violence protective order is filed initially in Magistrate Court. If an Emergency Protective Order is granted, the case is transferred to Family Court for a final hearing. Click the DVPO Forms icon to access forms.
